Terms of Service

1. Definitions

"mapped.store," "we," "us," or "our" refers to the company operating the mapped.store retail floorset mapping platform. "Service" means the mapped.store web application, APIs, and any associated tools or features. "User," "you," or "your" refers to any individual or entity that accesses or uses the Service. "Content" means any floorplan data, product placement information, annotations, images, or other materials uploaded, created, or stored through the Service. "Workspace" means a shared organizational account that may include multiple team members.

2. Eligibility

You must be at least 18 years of age and capable of forming a binding contract to use the Service. By using mapped.store, you represent and warrant that you meet these requirements. If you are accessing the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

3. Account registration

To access the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that contain inaccurate or misleading information.

You may not share your account credentials with others outside of the seat-based access controls provided within your Workspace. Each individual user must have their own account.

4. License and access

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your internal retail merchandising and floorset planning operations. This license does not permit you to resell, sublicense, or otherwise make the Service available to third parties as a standalone product.

All rights not expressly granted in these Terms are reserved by mapped.store.

5. Acceptable use

You agree to use the Service only for lawful purposes. You may not:

  • Attempt to gain unauthorized access to any part of the Service or its underlying infrastructure;
  • Use automated scripts, bots, or scrapers to extract data from the Service without our written consent;
  • Reverse engineer, decompile, or disassemble any component of the Service;
  • Upload or transmit malicious code, viruses, or any content that could disrupt or damage the Service;
  • Use the Service to violate any applicable law, regulation, or third-party right;
  • Misrepresent your identity, affiliation, or the origin of any Content you upload;
  • Interfere with or circumvent features related to account security or access controls.

6. Intellectual property

The Service, including all software, design elements, visual interfaces, algorithms, and documentation, is owned by mapped.store and protected by copyright, trademark, and other intellectual property laws. The mapped.store name, logo, and product names are trademarks of mapped.store. Nothing in these Terms grants you any right to use our trademarks or branding without our prior written consent.

Any feedback, suggestions, or ideas you submit regarding the Service may be used by us without obligation or compensation to you.

7. Your content

You retain ownership of all Content you create or upload through the Service. By submitting Content, you grant mapped.store a limited, worldwide, royalty-free license to host, store, transmit, and display your Content solely as necessary to operate and provide the Service to you.

You represent and warrant that you have the rights to upload and use all Content you submit, and that your Content does not infringe any third-party intellectual property, privacy, or other rights.

We do not sell your Content or use it to train machine learning models. Aggregated, de-identified usage data may be used to improve the Service.

8. Subscriptions and billing

Access to mapped.store requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis, depending on the plan you select. All fees are non-refundable except as required by applicable law or as expressly stated in a separate agreement.

We reserve the right to modify pricing with at least 30 days' advance notice delivered to the email address on file. Continued use of the Service after a price change takes effect constitutes your acceptance of the new pricing.

Failure to pay may result in suspension or termination of your account. You are responsible for all applicable taxes in your jurisdiction.

9. Data and privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We implement commercially reasonable technical and organizational measures to protect your data. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

If you process personal data through the Service on behalf of your organization, you are responsible for ensuring your use complies with applicable privacy laws, including obtaining any required consents.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. mapped.store is a planning and visualization tool — all merchandising decisions remain the sole responsibility of the user.

11. Limitation of liability

To the maximum extent permitted by applicable law, mapped.store and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising out of or related to your use of or inability to use the Service.

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the greater of (a) the amount you paid to mapped.store in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless mapped.store and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your Content, your violation of these Terms, or your violation of any third-party right.

13. Termination

You may cancel your account at any time through the account settings or by contacting support. Cancellation takes effect at the end of the current billing period.

We may suspend or terminate your access to the Service at our discretion, with or without notice, if we have reason to believe you have violated these Terms or pose a risk to the Service or other users. Upon termination, your license to use the Service will immediately cease.

You may export your Content prior to account closure. After account termination, we will retain your data for a period of 30 days before deletion, except where longer retention is required by law.

14. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for matters involving intellectual property.

You agree that any dispute resolution will be conducted on an individual basis and not as part of a class or representative action.

15. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and, for material changes, notify you via email or an in-app notice at least 14 days before the changes take effect. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
